Computer Crime Defense in Dayton
Defense Focused on Digital & Financial Evidence
These cases often turn on digital records, account activity, and financial documents that require careful review. At Kane Law, we provide criminal defense representation for people accused of computer crimes in Dayton, Ohio, and throughout the state. We examine the allegations and the evidence connecting a person to the digital or financial activity under investigation.
Cyber crime allegations can affect employment, finances, reputation, and personal privacy before a case reaches trial. We offer representation in English and Spanish so clients can discuss the allegations and legal process in the language they prefer. We begin by determining what investigators claim happened and what the available evidence shows.
Call (937) 887-4700 before answering questions or providing records to investigators. We can review the situation and explain your options.
Cyber-Related Charges Under Ohio Law
Cyber crime describes a range of conduct rather than a single criminal charge. Formal accusations typically identify a specific offense under Ohio law, and the precise statutory language matters. We review that language alongside the alleged conduct, the purpose attributed to it, and any related financial activity.
Unauthorized Computer Access & Hacking
Ohio Revised Code 2913.04 addresses unauthorized use of property and access to computer systems, networks, and telecommunications property without consent. Ohio law treats computer hacking as a form of unauthorized computer access. Section 2913.01 generally defines hacking to include unauthorized or attempted access intended to defraud or commit a crime, along with certain misuse of computer or network services.
An allegation of unauthorized access doesn’t establish who used an account, whether access was permitted, or what a person intended to do. Those issues may depend on login records, communications, and device access. We assess that evidence in context rather than relying on the label applied to the conduct.
Telecommunications Fraud & Financial Offenses
Section 2913.05 addresses telecommunications fraud. Depending on the allegations, a computer-related investigation may overlap with the following white-collar offenses:
- Fraud
- Identity theft
- Credit card-related offenses
- Forgery
- Money laundering
We defend clients against these charges, including allegations involving online accounts and financial records.
Whether an offense is charged as a misdemeanor or felony depends on the statute and the allegations in the individual case. Relevant factors may include alleged financial loss, the purpose of the conduct, and whether access was unauthorized. Case-specific legal advice requires a review of the actual charge and supporting records.
Digital Evidence in Cyber Crime Investigations
An investigation can begin with a report from a person, business, or law-enforcement agency. Investigators may use subpoenas to obtain digital and financial records. They may also examine forensic data, which is information extracted or recovered from digital devices and systems.
Digital records require more than a surface reading. A defense review considers how investigators obtained the information, what the records show, and whether they connect the accused person to the alleged conduct. Timing, account access, and authorship may require close attention based on the facts of the case.
Evidence that may arise in a digital-offense or fraud investigation includes:
- Charging documents describing the alleged offense
- Subpoenas and agency letters requesting information or records
- Online account records, emails, and other communications
- Bank statements, transaction histories, and financial records
- Business documents and complex paper trails
- Device information and other forensic data
During an initial consultation, we review the available records and place them in the context of the allegations. If investigators contact you, don’t answer substantive questions before speaking with our attorneys.
Preparing a Defense in Dayton
Our review starts with the charge, the prosecution’s evidence, and the circumstances surrounding the alleged conduct. We examine the connection between the accused person and the digital activity at issue, including whether the records support the alleged intent, access, or financial conduct.
